The Second Look Act is the third iteration of the IRAA — a 2106 D.C. Council created law that addresses issues of young offenders in the District. IRAA’s 2016 version provided relief and reconsideration for juveniles that were tried as adults — those who had served at least 20 years and had not yet qualified for parole — could petition to have their sentences reduced by the superior court. The revised 2019 version of the law would allow juveniles who’d served 15 years, as well as those who’d been denied parole, the ability to request a sentence reduction. 

From Netflix's 'When They See Us'

I watched Ava DuVernay’s Netflix series When They See Us and found myself angered by the people and systems that had a role in the incarceration of five innocent boys. The Central Park Five, Raymond Santana, Kevin Richardson, Antron McCray, Yusef Saalam, and Korey Wise, were wrongfully convicted and later exonerated of a variety of charges related to the rape and assault of a white female jogger in 1989. While the series itself honors the stories of the Central Park Five, in choosing to title the series When They See Us, DuVernay invites us into a broader conversation on the criminalization and mass incarceration of young boys and girls of color, and challenges us to define our own role within this system.

THE WEEK OF JESUS’ resurrection is his first week home from prison after a very public arrest, trial, imprisonment, and death sentence. Jesus’ closest friends do not recognize him; they are frightened and mistake Jesus for everything from a ghost (Luke 24:37) to a thieving gardener (John 20:15).

Biblical interpreters have spent thousands of years trying to make sense of why the seemingly joyful event of Jesus’ resurrection is haunted by unrecognition. Many have presumed that Jesus rises from the grave with a body that is somehow different—flesh that bears the marks of the execution but has somehow been transformed. If Jesus has come back with a changed body, the argument goes, then the fear and lack of recognition that his disciples show toward him make sense.

Perhaps. But after many years of friendship with people who have been locked up and released, I have come to see that the stories of Jesus in the wake of his resurrection look startlingly like the experiences of every other formerly incarcerated person in the wake of his or her release. Miraculous bodies and transfigured flesh are not needed to explain the fear and awkward renegotiation of relationships that pervade the Easter stories: Jesus is home from prison, and his church simply doesn’t know what to do with him.

CNN commentator Van Jones, co-founder of #cut50, an initiative to reduce the prison population, moderated a Saturday morning panel at the annual winter meeting of governors. Jones worked with the Trump administration to rally support for the First Step Act, which the president signed into law in December. Jones called Republican Gov. Phil Bryant “our secret weapon” in convincing Donald Trump to support the criminal justice reform bill.

In Brown’s case, her crime is murder, but the factors leading to her crime should impact the way prosecution tries and sentences. It has been reported that she suffered from Fetal Alcohol Syndrome at birth, was given up for adoption, placed in foster care, and then became a sex trafficking victim. Children and youth are full human beings capable of making moral choices and should be held responsible for them, but to punish without a thorough investigation of their vulnerabilities as minors is injustice.

The day when I was a kid, I watched that bird escape and fly away, not once did I consider what the ordeal it must’ve been like for it. How afraid it must’ve been being swallowed up in the darkness. The loneliness it must’ve felt. Confusion. The hurt and anger of being violated and victimized. And what of the consequences had it never returned to the nest. Would its family miss it? Would there be songs to mourn its absence? Were there young that depended on its safe return for survival?

President Donald Trump promised Friday at a prison reform summit at the White House that a bill to reform the U.S. incarceration system is “going to be strong, it’s going to be good, it’s going to be what everyone wants.” Members of Congress from both sides of the aisle, though, said the bill does not do enough to address prison reform, making the passing of a bill less and less likely before the midterm elections.

TWO WEEKS BEFORE Christmas last year, I stood with 50 other national faith leaders on the banks of the Alabama River in Montgomery, Ala., trying to imagine what it must have been like to stand on that land in 1850, at the height of the black chattel slave trade.

We were embarking on a one-day pilgrimage convened by Sojourners and hosted by the Equal Justice Initiative (EJI). We were there to understand one thing: the nature of the confinement and control of black bodies in the U.S. from chattel slavery through Jim Crow to mass incarceration.

Congress banned the import of enslaved people in 1808, but it did not ban the slave industry. Slave traders turned inward. Men, women, and children of African descent were sold in the Upper South; chained together with shackles around their feet, wrists, waists, and necks; and marched—often without shoes—over hundreds of miles into the Deep South for sale to farm owners desperate to meet the explosive global demand for cotton after the invention of the cotton gin.

“But walking was too slow and expensive to meet the high demand,” said Bryan Stevenson, founding executive director of EJI, to the faith leaders standing at the mouth of Montgomery’s Commerce Street. Stevenson explained that sales multiplied as transport methods improved. By the 1840s, the Commerce Street port housed a steamboat dock and a train station. Rather than marching 20 people over hundreds of miles, traders could transport hundreds of en-slaved people at a time—quicker and less expensive. Slavery was industry. Even in these early iterations, maximizing profit and lowering the bottom line were of chief concern.

According to a 2013 EJI report, “Slavery in America: The Montgomery Slave Trade,” Montgomery’s Commerce Street became one of the most easily accessible points of trade in Alabama by 1860. Slave traders would unload humans from ships and trains at the top of Commerce Street and auction them three blocks away at Court Square. Auctioneers coaxed farm owners to push bids higher until the auctioneer cried “Sold!” Mothers were separated from sons and daughters. Sisters were separated from brothers. And husbands were separated from wives. Humans were forced to fill days with bone-breaking labor, heartache, and absolute acquiescence to the domination of overseers and masters—until death freed them from the clutch of American commerce.

Another issue that we know: In a number of states, pregnant women, when they give birth in the midst of their sentences, they’re forced to be shackled to a gurney in the midst of their delivery process. We know being born into that stress-induced state has irreversible cognitive impacts on the child, but we still haven’t changed the law in light of that.

The United States holds the title for having the highest incarceration rate in the world with 2.3 million incarcerated people. And the most rapidly increasing population imprisoned are women and girls.

CRIMINAL JUSTICE REFORM in the United States is gaining momentum with each graphic video showing fatal police abuse. In the aftermath of the many deaths of unarmed black men and women and the city-wide protests that erupted in Ferguson, Baltimore, and Cleveland, it is not surprising that presidential hopefuls are making bold public statements about the need to change a system that is profoundly unjust, overly punitive, and excessively costly to run.

At the other end of the spectrum, away from TV cameras and political wrangling, activists such as Tara Libert and Kelli Taylor, co-founders of the Free Minds Book Club and Writing Workshop, are dealing with decades of draconian anti-crime policies that have resulted in mass incarceration rates marked by racial disparities that have had a devastating impact on families and communities.

The numbers speak for themselves. Although the United States makes up less than 5 percent of the world’s population, it has nearly 25 percent of its prison population. According to The Sentencing Project, a research and advocacy organization working to reform the U.S. criminal justice system, more than 2.2 million Americans are now locked up in prisons and jails across the country—a 500-percent increase over the past 30 years. Furthermore, those who are incarcerated come largely from the most disadvantaged segments of the population.

I started this year in solitary confinement.

It’s not that I am regularly in prison or that I had behaved so badly. I was simply in a mock solitary cell located in the sanctuary of a church. I was only there for an hour. I knew I would be getting out.

But that hour did offer a glimpse into the world of how solitary confinement is used – and abused – in our nation’s prisons. And it offered a glimpse at the reform efforts that are gaining steam all across the country, including in my home state of Wisconsin.

When Kate Edwards, a Buddhist chaplain who has worked in the Wisconsin prison for the past five-and-half years, closed the door behind me, I was alone, but hardly in silence.

In January 2011, members of Christian Churches Together in the U.S.A. met in Birmingham, Ala., to examine issues of domestic poverty and racism through the lens of the civil rights movement and by reading together Martin Luther King Jr.'s "Letter from Birmingham Jail." As they gathered in the 16th Street Baptist Church under the beautiful Wales Window portraying the black Christ, which replaced the window blown out when the church was bombed in 1963, these contemporary church leaders, representing the broadest Christian fellowship in the country—36 national communions and seven national organizations, including Sojourners—realized that apparently no clergy had ever issued a response to King's famous letter, even though it was specifically addressed to "fellow clergymen [sic]." In 2013, to mark the 50th anniversary of King's letter, Christian Churches Together released its thoughtful response, which we excerpt below. —The Editors

WE CONFESS. As leaders of churches claimed by more than 100 million Americans; as Catholics, evangelicals, Pentecostals, Orthodox, Historic Protestants, and members of Historic Black denominations; as people of many races and cultures: We call ourselves, our institutions, and our members to repentance. We make this confession before God and offer it to all who have endured racism and injustice both within the church and in society.

As church leaders, we confess we have tended to emphasize our responsibility to obey the law while neglecting our equal moral obligation to change laws that are unjust in their substance or application. All too often, the political involvement of Christians has been guided by the pursuit of personal or group advantage rather than a biblically grounded moral compass. We confess it is too easy for those of us who are privileged to counsel others simply to "wait"—or to pass judgment that they deserve no better than what they already have.

We confess that we are slow to listen and give legitimacy to those whose experience of race relations and social privilege in America is different than our own. We keep the "other" at arm's length to avoid hearing the call to sacrifice on their behalf. Our reluctance to embrace our "inescapable network of mutuality" underscores Dr. King's observation that privileged groups seldom give up their advantages voluntarily. For example, it is difficult to persuade most suburban Christians to demand that they strive for the same quality of education in our cities that they take for granted in their own schools. To the extent that we do not listen in love, our influence in society is limited to "a weak, ineffectual voice with an uncertain sound."

RICHARD VIGUERIE is as responsible as anyone for the success of the conservative movement in this country. A pioneer in political direct mail, Viguerie has been involved from the radical edges of the Right in every Republican campaign from Goldwater to Romney; he's been called the "funding father of the conservative movement." He helped start hundreds of entities from Conservative Digest to Gun Owners of America, from the National Conservative Political Action Committee to the Moral Majority—spanning the political spectrum from Right to Far Right. Just before the 2012 election, he launched MyOwnSuperPAC because of "frustration at how weak and ineffective the Romney campaign's ads have been with its soft approach to Barack Obama—hardly ever mentioning Obama's radical, neo-Marxist vision for America's future," and insisting that "Obama is NOT failing. He's succeeding at doing exactly what he set out to do—and that's destroy capitalism and destroy the America you and I grew up in." So no one is going to mistake Viguerie for a squishy liberal.

And yet Viguerie's Catholic faith has led him to a surprising position on the issues of capital punishment and prison reform. The conservative icon talked with Sojourners editor-in-chief Jim Wallis in September about why he thinks an unexpected Left-Right alliance might turn the tide against the death penalty.

Jim Wallis: As you and I both know, we're often stuck in political straitjackets. There are issues that we could work together on, particularly as people of faith, that would help politicians do better than they sometimes do. I'd like to start with this: You've said that, as a Catholic, you're against the death penalty. Why is your faith as a Catholic central to this, and how has that turned you against the death penalty?

Richard Viguerie: My own road to Damascus on this issue came many years ago. When I was a young Republican in Houston in the late '50s and early '60s, I was a very hard-core, law-and-order type: "lock 'em up, throw the key under the jail so they never get out." In those days, law enforcement agencies were kind of immune from criticism. Over a period of time, I and many other conservatives have been disabused of the fact that people in law enforcement are above any mistakes or abuse of power.
